Voordat je Het Laatste Dorp speelt, vragen wij je het volgende te lezen. Dit is een juridisch bindende overeenkomst tussen jou en EverLingeringStories. Door het spel te installeren of te gebruiken, ga je akkoord met de voorwaarden in dit document. Als je niet akkoord gaat, installeer of gebruik het spel dan niet.
Artikel 1 — Partijen en erkenning
Deze overeenkomst (hierna: "EULA") is uitsluitend van toepassing tussen EverLingeringStories, gevestigd te Heesch, Nederland (hierna: "Ontwikkelaar"), en de natuurlijke persoon die het spel installeert of gebruikt (hierna: "Gebruiker"). Het Laatste Dorp is een interactief narratief spel (hierna: "het Spel"), uitgebracht door de Ontwikkelaar.
De Gebruiker erkent dat deze EULA uitsluitend is gesloten met de Ontwikkelaar en niet met Apple Inc. ("Apple"). De Ontwikkelaar, en niet Apple, is als enige verantwoordelijk voor het Spel en de inhoud daarvan. Deze EULA is niet in strijd met de Apple Media Services Voorwaarden en Bepalingen.

Artikel 2 — Leeftijdsgrens
Het Spel is uitsluitend bestemd voor personen van achttien (18) jaar of ouder. Het bevat zware thema's, waaronder maar niet beperkt tot: existentieel geweld, menselijk verval onder extreme druk, sterfte en psychologische horror. Door het Spel te installeren of te gebruiken, verklaart de Gebruiker dat hij of zij minimaal achttien (18) jaar oud is. Als een minderjarige toegang heeft gekregen tot het Spel, is de verantwoordelijkheid daarvoor bij de ouder of wettelijk voogd gelegen.
Artikel 3 — Licentieverlening
De Ontwikkelaar verleent de Gebruiker een niet-exclusieve, niet-overdraagbare, herroepelijke licentie om het Spel te installeren en te gebruiken op Apple-apparaten die eigendom zijn van of gecontroleerd worden door de Gebruiker, uitsluitend voor persoonlijk, niet-commercieel gebruik en in overeenstemming met de Gebruiksregels (Usage Rules) zoals vastgesteld in de Apple Media Services Voorwaarden en Bepalingen. De Gebruiker verkrijgt geen eigendomsrecht op het Spel of enig onderdeel daarvan.
Deze licentie is tevens van toepassing wanneer het Spel wordt gedeeld via Apple's gezinsdeelfunctie (Family Sharing) of volumeaankopen, voor zover de toepasselijke Gebruiksregels dit toestaan.
Artikel 4 — Beperkingen
De Gebruiker mag het Spel of enig onderdeel daarvan niet kopiëren, reproduceren, distribueren, verkopen, verhuren, bewerken, reverse engineeren of voor commerciële doeleinden gebruiken zonder uitdrukkelijke schriftelijke toestemming van de Ontwikkelaar. Schending kan leiden tot beëindiging van de licentie en aansprakelijkheid voor geleden schade.
Artikel 5 — Intellectueel eigendom
Alle intellectuele eigendomsrechten met betrekking tot het Spel — waaronder verhaalteksten, audioproducties, softwarecode en vormgeving — berusten bij de Ontwikkelaar. Niets in deze overeenkomst leidt tot overdracht van intellectuele eigendomsrechten aan de Gebruiker.
In geval van een claim van derden dat het Spel inbreuk maakt op intellectuele eigendomsrechten, is de Ontwikkelaar — en niet Apple — verantwoordelijk voor het onderzoek, de verdediging, de schikking en de kwijting van een dergelijke claim.
Artikel 6 — In-app aankopen
Het Spel biedt optionele digitale inhoud aan via in-app aankopen. Deze aankopen zijn eenmalig, niet-restitueerbaar en niet-overdraagbaar, tenzij anders bepaald door de App Store-voorwaarden van Apple. Op verzoeken tot terugbetaling zijn de voorwaarden van Apple van toepassing.
Artikel 7 — Disclaimer en aansprakelijkheidsbeperking
Het Spel wordt aangeboden "zoals het is", zonder enige garantie. De Ontwikkelaar is niet aansprakelijk voor indirecte schade of gevolgschade die voortvloeit uit het gebruik of het niet kunnen gebruiken van het Spel, tenzij er sprake is van opzet of grove nalatigheid. De aansprakelijkheid is in elk geval beperkt tot het door de Gebruiker betaalde bedrag.
Indien het Spel niet voldoet aan een toepasselijke garantie, kan de Gebruiker Apple hiervan op de hoogte stellen, waarna Apple de aankoopprijs van het Spel mag restitueren. Voor zover toegestaan door het toepasselijk recht draagt Apple geen enkele verdere garantieverplichting met betrekking tot het Spel. Alle overige claims, verliezen, aansprakelijkheden, schade, kosten of uitgaven die voortvloeien uit het niet voldoen aan een garantie zijn de verantwoordelijkheid van de Ontwikkelaar.
Artikel 8 — Privacy
Het Spel verzamelt geen persoonlijke gegevens van de Gebruiker. Spelvoortgang en instellingen worden uitsluitend lokaal opgeslagen op het apparaat van de Gebruiker. Voor in-app aankopen via Apple zijn de privacyvoorwaarden van Apple van toepassing.
Artikel 9 — Onderhoud en support
De Ontwikkelaar is als enige verantwoordelijk voor het onderhoud van en de supportverlening voor het Spel. Apple heeft geen enkele verplichting tot het verlenen van onderhoud of supportdiensten met betrekking tot het Spel. Supportverzoeken kunnen worden gericht aan de Ontwikkelaar via de contactgegevens in artikel 1 of via everlingeringstories.com/support/het-laatste-dorp.
Artikel 10 — Productclaims
De Ontwikkelaar, en niet Apple, is verantwoordelijk voor de behandeling van alle claims van de Gebruiker of derden met betrekking tot het Spel of het bezit en/of gebruik daarvan, met inbegrip van maar niet beperkt tot: (i) productaansprakelijkheidsclaims; (ii) claims dat het Spel niet voldoet aan toepasselijke wet- of regelgeving; en (iii) claims op grond van consumentenbescherming, privacywetgeving of soortgelijke regelgeving.
Artikel 11 — Exportbeperking en naleving
De Gebruiker verklaart en garandeert dat (i) hij of zij zich niet bevindt in een land dat onderworpen is aan een embargo van de Amerikaanse overheid of dat door de Amerikaanse overheid is aangewezen als een land dat "terrorisme ondersteunt"; en (ii) hij of zij niet voorkomt op een lijst van de Amerikaanse overheid van verboden of beperkte partijen.
Artikel 12 — Derde-partij voorwaarden
De Gebruiker dient bij het gebruik van het Spel te voldoen aan alle toepasselijke voorwaarden van derden, waaronder de voorwaarden van de draadloze gegevensverbinding van de Gebruiker.
Artikel 13 — Wijzigingen
De Ontwikkelaar behoudt het recht om deze overeenkomst te wijzigen bij updates van het Spel of wijzigingen in wetgeving. Wijzigingen worden van kracht op het moment dat de Gebruiker een bijgewerkte versie installeert en de gewijzigde voorwaarden accepteert.
Artikel 14 — Beëindiging
Deze overeenkomst eindigt van rechtswege op het moment dat de Gebruiker het Spel verwijdert. De Ontwikkelaar kan de licentie met onmiddellijke ingang beëindigen bij schending van een van de bepalingen.
Artikel 15 — Toepasselijk recht
Op deze overeenkomst is uitsluitend Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement 's-Hertogenbosch, Nederland. Als een bepaling nietig is, tast dit de geldigheid van de overige bepalingen niet aan.
Artikel 16 — App Store-voorwaarden en derde-partij begunstigde
Deze overeenkomst is een aanvulling op de Licentieovereenkomst voor eindgebruikers van Apple (Apple Licensed Application End User License Agreement). In geval van strijdigheid prevaleren de voorwaarden van Apple.
De Gebruiker erkent en stemt ermee in dat Apple en haar dochterondernemingen derde-partij begunstigden zijn van deze EULA. Na aanvaarding van deze EULA door de Gebruiker heeft Apple het recht (en wordt geacht dit recht te hebben aanvaard) om deze EULA jegens de Gebruiker als derde-partij begunstigde af te dwingen.

Before playing Het Laatste Dorp, please read the following carefully. This is a legally binding agreement between you and EverLingeringStories. By installing or using the game, you agree to the terms set out in this document. If you do not agree, do not install or use the game.
Article 1 — Parties and Acknowledgement
This agreement (hereinafter: "EULA") applies exclusively between EverLingeringStories, established in Heesch, the Netherlands (hereinafter: "Developer"), and the natural person who installs or uses the game (hereinafter: "User"). Het Laatste Dorp is an interactive narrative game (hereinafter: "the Game"), published by the Developer.
The User acknowledges that this EULA is concluded solely with the Developer and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Game and its content. This EULA does not conflict with the Apple Media Services Terms and Conditions.

Article 2 — Age Restriction
The Game is intended exclusively for persons aged eighteen (18) years or older. It contains mature themes, including but not limited to: existential violence, human deterioration under extreme pressure, death, and psychological horror. By installing or using the Game, the User declares that they are at least eighteen (18) years of age. If a minor has gained access to the Game, responsibility lies with the parent or legal guardian.
Article 3 — Grant of Licence
The Developer grants the User a non-exclusive, non-transferable, revocable licence to install and use the Game on Apple-branded products owned or controlled by the User, solely for personal, non-commercial purposes and in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions. The User does not acquire any ownership rights in the Game or any part thereof.
This licence also applies when the Game is shared through Apple's Family Sharing or volume purchase programmes, to the extent permitted by the applicable Usage Rules.
Article 4 — Restrictions
The User may not copy, reproduce, distribute, sell, rent, modify, reverse engineer or use the Game for commercial purposes without the prior written consent of the Developer. Violation may result in termination of the licence and liability for damages.
Article 5 — Intellectual Property
All intellectual property rights relating to the Game — including narrative texts, audio productions, software code and design — are vested in the Developer. Nothing in this agreement results in the transfer of intellectual property rights to the User.
In the event of a third-party claim that the Game infringes intellectual property rights, the Developer — not Apple — shall be responsible for the investigation, defence, settlement and discharge of any such claim.
Article 6 — In-App Purchases
The Game offers optional digital content through in-app purchases. These purchases are one-time, non-refundable and non-transferable, unless otherwise determined by Apple's App Store terms. Refund requests are subject to Apple's terms and conditions.
Article 7 — Disclaimer and Limitation of Liability
The Game is provided "as is", without any warranty. The Developer is not liable for indirect or consequential damages arising from the use or inability to use the Game, unless there is intent or gross negligence. Liability is in any case limited to the amount paid by the User.
In the event the Game fails to conform to any applicable warranty, the User may notify Apple, and Apple may refund the purchase price of the Game. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Game. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Developer.
Article 8 — Privacy
The Game does not collect any personal data from the User. Game progress and settings are stored exclusively on the User's device. Apple's privacy terms apply to the processing of data related to in-app purchases.
Article 9 — Maintenance and Support
The Developer is solely responsible for providing maintenance and support services with respect to the Game. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with the Game. Support requests may be directed to the Developer via the contact details in Article 1 or at everlingeringstories.com/support/het-laatste-dorp.
Article 10 — Product Claims
The Developer, not Apple, is responsible for addressing any claims by the User or any third party relating to the Game or the User's possession and/or use thereof, including but not limited to: (i) product liability claims; (ii) any claim that the Game fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy legislation or similar statutes.
Article 11 — Export Compliance
The User represents and warrants that (i) they are not located in a country that is subject to a United States Government embargo, or that has been designated by the United States Government as a "terrorist supporting" country; and (ii) they are not listed on any United States Government list of prohibited or restricted parties.
Article 12 — Third-Party Terms
The User must comply with applicable third-party terms of agreement when using the Game, including the User's wireless data service agreement.
Article 13 — Amendments
The Developer reserves the right to amend this agreement in connection with updates to the Game or changes in legislation. Amendments take effect when the User installs an updated version and accepts the amended terms.
Article 14 — Termination
This agreement terminates by operation of law when the User removes the Game from their device. The Developer may terminate the licence with immediate effect if the User breaches any provision.
Article 15 — Governing Law
This agreement is governed exclusively by Dutch law. Disputes shall be submitted to the competent court in the district of 's-Hertogenbosch, the Netherlands. If any provision is void, this does not affect the validity of the remaining provisions.
Article 16 — App Store Terms and Third-Party Beneficiary
This agreement supplements the Apple Licensed Application End User License Agreement. In the event of conflict, Apple's terms prevail.
The User acknowledges and agrees that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon the User's acceptance of this EULA, Apple shall have the right (and will be deemed to have accepted that right) to enforce this EULA against the User as a third-party beneficiary thereof.
